Enforcement proceedings

Are you not satisfied with the processing of your enquiry? Or you have not received a response to your feedback within six weeks? In this case, you can submit an application to the Monitoring Centre for Digital Accessibility of Public Bodies in Mecklenburg-Vorpommern to have the regulations and measures specified in the accessibility declaration reviewed.
The monitoring centre is responsible for the complaints and enforcement procedure in accordance with Section 2 (1) BITVO M-V. At your request, it will check whether further measures are required vis-à-vis the public body. The complaints and enforcement procedure is free of charge for you as the complainant. You do not need legal assistance.

After receipt of the complaint, the following steps will be taken:

  • Check whether actual accessibility violations can be identified
  • The public body is requested to rectify the defects within a certain period of time. In return, it receives proposals for implementation.
  • If the public body does not comply with the complaint, it must justify this to the monitoring body
  • All parties involved are informed about the status of the process
  • Conclusion of the enforcement procedure by means of a summarising final notification to the complainant and explanation of the implementation.
  • Informing the public body and the specialised or legal supervisory authority responsible for it

You can report your complaint as follows. Please provide your name, address, website/mobile application and the reason for your complaint.

Independently of the complaints procedure, the enforcement procedure can also be initiated by the Monitoring Centre for Digital Accessibility of Public Bodies in Mecklenburg-Vorpommern itself on the basis of identified deficiencies.
