    As the organiser, you can

    • Trade fairs,
    • Exhibitions and
    • Markets

    can be fixed.

    This means that you are exempt from the provisions of the Shop Opening Act, the Sunday and Public Holidays Act, the Working Hours Act and the Trade Regulations. You can submit the application as a trader.

    The authorisation includes the subject matter, period, opening hours and location of the event. Provided there are no public interest concerns to the contrary, markets can be authorised for a longer period or permanently. For trade fairs and exhibitions, however, this is only possible for events scheduled to take place within 2 years.

    It is up to you to decide whether to submit an application to organise an event. However, non-scheduled events are subject to the general regulations, for example

    • the travelling trade licence requirement,
    • the right to open shops,
    • the Working Hours Act and
    • the law protecting Sundays and public holidays.

    Without a determination, you may have to apply for exceptions to this with the relevant authorities.

    A determination replaces these individual exceptions. You receive the so-called market privileges from a single source.

    However, you also have special obligations to observe when making a determination.

    The documents to be submitted may depend, among other things, on whether it is a first event or a follow-up event.

  • Prerequisites

    You must organise one of the following events:

    • Trade fair
    • Exhibition
    • Wholesale market
    • Weekly market
    • Speciality market
    • Funfair
  • Costs (fees, expenses, etc.)

    Prepayment: No
    for the authorisation of an event. The amount of the fee depends on the time required to process the application. In addition, there are costs for applying for information from the Federal Register and the Central Trade Register at the relevant authorities. These will be invoiced to you.

  • Procedure

    Before you can organise an event, you must submit an application to the competent authority. You can submit this application online via the online service or using a PDF form.

    If you wish to apply for the authorisation using a PDF form:

    • Open the corresponding form.
    • Fill in the application form.
    • Submit the required evidence.
    • Send the application by e-mail or by post to the competent authority.
    • The competent authority will contact you if there are any queries regarding the determination.
    • In the event of an assessment, you will receive a notification from the competent authority by post and/or e-mail.
    • In the event of a rejection, you will receive a rejection notice by post from the competent authority.
    • You will receive a notification of fees.

    If you wish to apply for fixing via the online service:

    • You call up the online service.
    • You fill in the application form.
    • For quick processing by the authorities, upload all the necessary supporting documents.
    • Your application will be examined by the competent authority.
    • The next steps correspond to the application using the PDF form.
  • Processing time

    Processing takes approx. 4 weeks to 6 weeks. The processing time depends on whether it is a first event or a follow-up event. The processing time also depends on when the required documents are received (processing time at the Federal Office of Justice, which is responsible for the Federal and Central Commercial Register extracts, is usually 2 to 3 weeks).

  • Deadlines

    There is no statutory application deadline. As a rule, applications must be submitted 4-6 weeks before the start of the event to ensure that applications are processed on time.

    The trade licensing office of the independent city, the large city belonging to a district, the office or the independent municipality in which the activity is to take place is responsible for processing the application in M-V.
